The Texas Parks and Wildlife Code states: “Section 31.003. DEFINITIONS: (17) “Abandoned vessel or outboard motor” means a vessel or outboard motor that has remained on private property without the consent of the owner or person in charge of the property for more than seven consecutive days.”
Abandoned boats can be very serious hazards to navigation," said Craig Cook with Texas General Land Office, who has extensive experience with the issue of derelict boats in Texas coastal waters. "There's the environmental problems, mainly from leaking fluids - gasoline, oil. And they cost the public a lot of money to remove."
"Abandoned boats are a problem," Cook said. "What do people do with an unwanted boat - a worn-out boat that doesn't have any monetary value? The answer for too many people is they just leave it somewhere.
"Removing derelict boats from Texas coastal waters is hideously expensive."
"On average, it costs about $200 a foot to remove and dispose of an abandoned vessel," Cook said.
"So, a 20-foot boat will cost $4,000 to remove. It doesn't take many of those to add up to a lot of money."

So unusable boats with no value are often simply abandoned.

But it is tough for law enforcement officers to pin the crime on the perpetrators. It usually is easy to find the last legal owner of a vessel through checking boat registration records. (Many times the boat's registration numbers - called "TX" numbers - are removed, but the boat's hull identification number, which is inscribed in multiple locations on the boat, can lead to the last registered owner.) But the boat's registered owner may have sold the boat long ago, and subsequent owners never registered it.
Criminal cases involving abandoned boats are occasionally pursued, and charges can get as serious as a state jail felony, Cook said. But those instances are rare.
